Employers’ Liability (EL) indemnifies policyholders for their liabilities towards their employees in respect of bodily injury caused to them as a result of negligence or breach of a statutory duty.
The definition of bodily injury includes some psychological injury. In the UK, EL is a compulsory class of business and the extent of cover provided is governed by the Employers’ Liability (Compulsory Insurance) Act 1969, the Employers’ Liability (Compulsory Insurance) Regulations 1998 and subsequent amendments to such Regulations. EL is also purchased in other countries, for example, the Republic of Ireland, although it is not a compulsory class there. In the UK, EL is underwritten on a causation policy trigger.
Most EL policies are underwritten on a conventional basis, that is, ground up without an excess or deductible.
